Convicted and sentenced to death for a kidnapping resulting in the death of a college student. Death sentence reversed by the U.S. District Court for the District of North Dakota on September 3, 2021 for ineffective assistance of counsel in the penalty phase of trial.
What follows is a look at some of the most prolific serial killers the country has ever seen, including one murderer whose identity eluded authorities for decades, until his eventual capture in 2018.
In June 2020, as part of a deal to avoid the death penalty, DeAngelo pleaded guilty to 13 counts of first-degree murder and as well as 13 counts of kidnapping. He later received multiple consecutive life sentences without the possibility of parole.
Agonizing DecisionAs part of the plea, Yates agreed to tell investigators where to find the body of a woman missing for two years if Spokane County prosecutors agreed not to seek the death penalty. The body was exhumed Monday, and while DNA tests on the remains of the woman, Melody Murfin, proved inconclusive, her relatives were able to identify some of the possessions found on the corpse.
And Justice For All?According to some experts, in cases like those of Yates and Swango, the best option for prosecutors is to not seek the death penalty and to try to find a solution that will benefit the community as a whole.
Isolated case. This happens all the time in the USA - especially with child molesters. We arrest them (because child molesters are KNOWN serial molesters), usually after they've molested several to hundreds of children, put them in jail for a few years, let them out, they molest, get caught (if society is lucky), put them back in jail....cycle goes on until they die - for which we the taxpayers get to pay. Civilization should be balanced against barbaric death penalties.
Hargrove, a retired investigative journalist, arrived at his estimate of about 2,000 at-large serial killers by asking some contacts at the FBI to calculate how many unsolved murders linked to at least one other murder through DNA were in their database, he explained to The New Yorker last year. Those officials determined that about 1,400 murders, or 2 percent of those in the database, met that classification.
The most prolific serial killer of the modern era was probably Harold Shipman, an English doctor who may have murdered as many as 250 patients with fatal doses of painkillers. The 2,000 theoretical killers don't have to meet such a staggering standard, considering that killing a minimum of two victims in separate incidents meets the FBI definition of serial killer.
By a far more conservative method of accounting, there are about 115 serial killers dating back to the 1970s in the United States whose crimes have never been solved. That estimate comes from Kenna Quinet, a criminologist at Indiana University-Purdue University Indianapolis. It's based on linkages between cases made by journalists or law enforcement, and includes a slightly different metric than Hargrove's estimate: The killer had to have murdered at least three victims, not two.
Florida's most notorious death row inmate to meet his demise sitting on "Old Sparky" was serial killer Ted Bundy in 1989 -- 10 years after he was sentenced to die for murdering two Chi Omega students at Florida State University.
Three years later, the U.S. Supreme Court struck down a portion of Florida's death penalty law, saying it was not sufficient for a judge to determine the aggravating factors to be used in considering a death sentence. The high court ruled that Florida's law violated the Sixth Amendment.
The governor has the right to commute the death penalty. Gov. Bob Graham granted six clemencies during his time in office. No other Florida governor since 1976 has granted clemency to a death row inmate.
But Brown and Coleman were both sentenced to death, and each made multiple unsuccessful appeals to have the sentences overturned. Coleman was executed April 26, 2002, in Ohio, while Brown was awaiting an execution date. She was slated to be the first woman executed in Indiana, since the U.S. Supreme Court reinstated the death penalty in 1976.
Instead, she was given the maximum sentence for murder, short of the death penalty, in addition to her other Indiana sentences. That totals 140 years, to be served consecutively with two sentences of life without parole in Ohio.
Struck by the similarities between the cases, Horgas told Williams about the Arlington murders, but Williams was skeptical of any connection. Arlington was too far away, he said, and according to psychological profiles prepared by FBI experts, serial killers were almost always white.
On July 11, 1988, Timothy Wilson Spencer went on trial in Arlington for the murder of Susan Tucker. On July 16, after six hours of deliberation, the jury found Spencer guilty of murder. In the next phase of the trial, they imposed the death penalty.
Dallas County District Attorney John Creuzot, a Democrat, decided to seek life sentences rather than the death penalty when he tried Chemirmir on two of his 13 capital murder cases in the county. His Republican opponent has criticized that decision as he seeks reelection in the nation's busiest death penalty state.
What made Sutcliffe and others like him the people they became? Ted Bundy (30 murders confirmed) Pedro Rodrigues Filho (70 murders confirmed) Luis Garavito (138 murders of street children confirmed). Were they natural-born killers all along, or did something change them and make them into serial killers?
Lawyers had been sending Fallon brain scans of convicted murderers in the hope that he could show there was something wrong with their brains that would perhaps get them a lighter sentence, or maybe help them escape the death penalty. After several years, Fallon was beginning to see a pattern.
